USER AGREEMENT
TERMS AND CONDITIONS FOR BUYERS
1. Introduction
Welcome to EarnersPay! By making a purchase through our platform, you the (“Buyer” or “User”) agree to these Terms and Conditions. Please read them carefully before proceeding to make your payment.
2. General Service Description
EarnersPay is an affiliate marketing platform that facilitates online sales of various digital info products. We provide a digital marketplace where affiliates can promote valuable digital products to their audience, and enable Vendors to connect with Buyers through our network of Affiliates, thereby boosting product sales for vendors.
EarnersPay is committed to providing a user-friendly experience for everyone and is registered as a trademark of Clems Digital Ltd. Vendors can easily list their products, Affiliates can promote these products to earn a commission, and Buyers can purchase quality digital products sold on our platform.
Please note: EarnersPay does not create or produce any of the digital products sold on its platforms. EarnersPay only represents the Vendors of all products sold on our platform.
3. Order Procedure
Buyers can purchase a variety of products listed on our platform through designated affiliate links. Vendors provide the information in each product listing, and we strive to ensure its accuracy. By placing an order, you are confirming your intent to purchase the specified product(s) on our platform. Once your payment is successfully processed, you will receive an order confirmation.
To ensure the highest level of security, all payments are processed through EarnersPay’s secure payment gateway. Our transactions are encrypted, protecting your personal and financial information throughout the purchase process. After successful payment, you will instantly receive an order confirmation email with your purchase details.
4. Disclaimers
EarnersPay provides affiliate links on our platform. This means we earn a commission if you make a purchase through these links, at no additional cost to you, the buyer.
EarnersPay may partner with certain vendors to facilitate the listing of their products on our platform. However, we maintain high standards for all products, regardless of any affiliate relationships.
Products purchased through our platform are for personal use only. Commercial use or resale of these products is highly prohibited.
Vendors are responsible for setting prices for their products on our platform, and these prices are subject to change. EarnersPay is not responsible for any pricing errors, inaccuracies, or discrepancies, and we advise buyers to verify prices before purchasing.
EarnersPay offers digital products on our platform in their current state and as they are available. We do not provide any guarantees, either expressed or implied. This includes, but is not limited to, guarantees that the products are suitable for a particular purpose, are of a certain quality, or do not infringe on any rights.
While we strive for a high level of service, EarnersPay does not guarantee uninterrupted, error-free operation of the platform, or that it is free of harmful components such as viruses or malware. We acknowledge that issues may arise, and we are committed to promptly identifying and addressing any errors or technical difficulties to improve user experience.
5. Prohibited Use and Security
Buyers must use this platform in compliance with all applicable laws. Misuse, including fraudulent activities, unsolicited spam, or illegal transactions, is strictly prohibited and may result in penalties or account suspension.
Buyers are responsible for maintaining the security and confidentiality of their account information, such as passwords. You must take precautions to prevent unauthorised access to your account and are fully accountable for all actions taken through your account, including any security breaches. Please notify EarnersPay’s support team immediately if you detect any suspicious activity or believe your account information has been compromised.
6. Privacy and Data Protection
By using our platform, you agree to the collection, storage, and use of your personal data as described in our Privacy Policy. EarnersPay may share your information with Vendors to process your orders. We are committed to protecting your privacy and ensuring your data is handled securely.
7. Limitation of Liability
To the fullest extent allowed by law, EarnersPay will not be responsible for any indirect, unintended, special, or consequential losses or damages of any kind that may arise from your use of our platform, even if we have been informed that such losses or damages are possible.
EarnersPay’s financial responsibility to the Buyer is limited to the amount paid for the specific transaction that caused the issue.
8. Indemnification
Buyers agree to indemnify EarnersPay, its staff, employees, and agents from any claims, harm, losses, liabilities, and expenses that may arise from your use of the platform, violation of these Terms, or any infringement of rights.
9. Terms Amendment
EarnersPay reserves the right to change these Terms and Conditions at any time. Buyers will be notified of significant changes, and your continued use of the platform after such changes means you accept the updated terms.
10. Severability
If any part of these Terms and Conditions is found to be invalid, illegal, or unenforceable under any law, the remaining parts will still be valid and enforceable.
11. Governing Law
This Agreement will be interpreted and enforced in accordance with Nigerian law. Any disputes related to these Terms will be resolved in the Nigerian court.
By making a purchase on EarnersPay’s platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
